The practice-oriented presentation highlighted the legal and economic options available to companies facing imminent bankruptcy or excessive debt.<\/p>\n<h5>Act early \u2013 know your legal obligations<\/h5>\n<p>A company is considered over-indebted or insolvent if its debts are no longer covered by its assets or if it can no longer meet its payment obligations. It is important to react early: the sooner measures are taken, the greater the chances of recovery.<\/p>\n<h5>Restructuring options and alternatives<\/h5>\n<p>Various measures can be considered to overcome financial difficulties:<\/p>\n<ul>\n<li><strong>Subordination<\/strong> of claims by shareholders<\/li>\n<li><strong>Capital reduction and re-increase<\/strong> (\u2018harmonisation restructuring\u2019)<\/li>\n<li><strong>Insolvency proceedings<\/strong> with debt deferral or debt reduction<\/li>\n<li>Establishment of a <strong>rescue company<\/strong> to continue profitable business areas<\/li>\n<\/ul>\n<p>It is essential that measures are implemented in good time and with professional support.<\/p>\n<h5>Conclusion<\/h5>\n<p>The presentation clearly showed that impending over-indebtedness does not automatically mean the end.
