The focus was on the question of when it makes sense to deliberately forego patents or other intellectual property rights \u2013 and how companies can still protect their innovations.<\/p>\n<h5>Strategic considerations instead of automatism<\/h5>\n<p>Not every innovation necessarily has to be patented. A no-patent <strong>strategy<\/strong> can be useful if:<\/p>\n<ul>\n<li>technologies are <strong>short-lived<\/strong> or difficult to enforce,<\/li>\n<li><strong>disclosure<\/strong> of the invention is <strong>not desired<\/strong> (e.g. secret know-how),<\/li>\n<li>open source or cooperation models are pursued,<\/li>\n<li>or the costs of registration and defence exceed the benefits.<\/li>\n<\/ul>\n<p>In such cases, companies can rely on factual or contractual protection mechanisms.<\/p>\n<h5>Alternatives to property rights<\/h5>\n<p>The key instruments include:<\/p>\n<ul>\n<li>Confidentiality agreements (<strong>NDAs<\/strong>)<\/li>\n<li>Precisely worded <strong>contracts<\/strong> with confidentiality and non-competition clauses<\/li>\n<li><strong>Technical protection measures<\/strong> (e.g. encryption, access restrictions)<\/li>\n<li><strong>Documentation and evidence<\/strong> to secure temporal priorities<\/li>\n<\/ul>\n<p>Case studies from practice have shown that a no-patent strategy only works if it is consciously planned and consistently implemented.<\/p>\n<h5>Conclusion<\/h5>\n<p>\u2018No strategy is not a strategy\u2019 \u2013 foregoing intellectual property rights can be worthwhile, but requires clear objectives and legally sound measures.
